Website accessibility lawsuits and demand letters are on the rise nationwide. Plaintiff filing rates have started to return to pre-COVID-19 levels of one-per-hour during working hours in federal court under the ADA. New data shows a significant number of accessibility lawsuits filed in California in state court under the Unruh Act. This rise in litigation shows that now, more than ever, it is critically important to understand the accessibility statutes in California including California Unruh Civil Rights Act (“Unruh Act”) and Title III of the Americans with Disabilities Act (“ADA”) and to apply that knowledge practically to the remediation of websites and mobile apps.
