Tile 1:

The UsableNet Research Team has been monitoring all of the Americans with Disabilities Act (ADA) website and mobile app related cases filed in Federal Court in 2019. This report highlights the numbers and trends so far this year.

Tile 2:

One Lawsuit every hour! 

In 2019 the flow of ADA web related lawsuits has reached a rate of one lawsuit every working hour; that’s 8 a day, 40 a week and on pace for over 2,000 a year.

2019 is set to beat 2018 and rack up over 2,000 digital accessibility related lawsuits again

Most cases settle and settle fast

A graphic communicates that 93% of cases from 2018 have settled while 7% remain open. UsableNet found that 55% of 2019 cases have already settled within 60 days.

Many get sued more than once

ADA web accessibility-related lawsuits can impact all industries but two stand out the most for companies being sued multiple times: retail and food service companies.

Retail is a top target

48% of the Internet Retailer’s Top 500 list have received a lawsuit claiming an inaccessible website related to one of theirs brands.***

The industries that received the biggest focus in web accessibility litigation include Retail, Food Service Industry, Travel/Hospitality, Banking/Financial, Entertainment & Leisure and Self-Service

The companies sued in these jurisdictions are distributed across the US. 
From a sample group, here is a list of the top 10 states where companies are headquartered portrayed through a map graphic:

  1. California – 22% of cases

  2. New York – 21% of cases

  3. Florida – 12% of cases

  4. Texas – 4% of cases

  5. New Jersey – 4% of cases

Additionally, 6% of companies sued are headquartered internationally including the United Kingdom, France, China and Brazil.
